In the Terms and Conditions below the word “Sports Fraternity”, which is the name of the Mobile Application, is interchangeably used for “Dreamerz Sports Fraternity LLP”
These Terms of Service (“Terms”) are a contract between you and Sports Fraternity Dot Com. These terms govern your use of Sports Fraternity Mobile App, Websites, Services, Products, and Content (“Services”).
By using Sports Fraternity, you agree to these Terms. If you don’t agree to any of the Terms, kindly do not use the services before contacting us regarding the same.
Sports Fraternity reserves the right to change these Terms at any time. By using Sports Fraternity on or after that effective date, you give your consent to the new Terms.
Content Rights & Responsibilities :
Sports Fraternity brings Players, Selectors, Sports Clubs & Teams , Merchants & Ground Owners (here on referred to as Members) on one common platform. Sports Fraternity is a platform which connects these members with each other and takes no responsibility between any dealings of the members in any way. Sports Fraternity accepts in good faith, the information being updated by the Members as correct and will not verify the same from any agency. For eg. While creating a profile, if a player states that he is a State player, then we will display his profile as a State player and will not seek any verification from the concerned state authorities. Sports Fraternity has implicit and explicit right to use images and videos uploaded on the Sports Fraternity plaform for it's marketing use. That images and videos uploaded on Sports Fraternity platform by players, coaches, clubs, merchants or any of its members can be used by Sports Fraternity for it's own marketing and promotion on various online and offline channels. By using Sports Fraternity app all it's members agree , without any conditions, that they do not have any objection to Sports Fraternity using their profile pictures, images and videos in it's marketing and promotion. Sports Fraternity on its part assures that any image and video will be used only in good faith.
Sports Fraternity may identify meritorious players and may promote them infront of relevant authorities, selectors which may help them progress in their respective sport. By using the sports fraternity App and web services, and uploading their game videos, profile information, all players give an unconditional consent to Sports Fraternity to use those videos & stats on their Home Page, Screen Sliders etc to highlight them. By using the Sports Fraternity Mobile App & Website, all members indemnify Sports Fraternity of any kind of loss arising out of their personal dealings.
By using Sports Fraternity you give us a right to publish the details so provided on Sports Fraternity platform (website, apps, etc.). We will store the information and may present it in the format as we deem fit. We may aggregate the information so provided by various members for internal data analysis. By using the services provided by Sports fraternity, you give your consent to enable advertising on the Sports Fraternity platform.
We may also use your content to promote Sports Fraternity and sell premium features by aggregating, normalising and enriching your Profile Videos.
Our Content and Services
We reserve all rights in Sports Fraternity’ look and feel. Some parts of Sports Fraternity are licensed under third-party open source licenses. As for other parts of Sports Fraternity, you may not copy or adapt any portion of our code or visual design elements (including logos) without express written permission from Sports Fraternity unless otherwise permitted by law.
You may not do, or try to do, the following: (1) access or tamper with non-public areas of the Services, our computer systems, or the systems of our technical providers (2) access or search the Services by any means other than the currently available, published interfaces (e.g., APIs) that we provide; (3) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive, or false source-identifying information or (4) interfere with, or disrupt, the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of content or accounts in such a manner as to interfere with or create an undue burden on the Services.
Crawling the Services is allowed if done in accordance with the provisions of our robots.txt file, but scraping the Services is prohibited.
We may change, terminate, or restrict access to any aspect of the service, at any time, without notice.
Conducting Sports Trials for Academies, Teams and Sports Events Organisers : Sports Fraternity is also in the business of connecting budding players, Sports students with relevant sports academies and Corporates. For this purpose, Sports Fraternity may conduct online registration campaigns on various social media platforms and offline mediums, to conduct Sports Trials from time to time. The sports trials will be conducted at the sports grounds/facilities provided by the academy/sports event management company. If, because of any reason, which may be beyond the control of Sports Fraternity, the Trial is not conducted on the stipulated Date and Time, all users agree to indemnify Sports Fraternity of any liability whatsoever. Sports Fraternity, on it’s part will always act in Good faith and will always try it’s level best to provide the best services to it’s users, which is in Sports Fraternity’s capacity. The registration fees so collected is NON REFUNDABLE. When user Registers for a Trial, he registers basis his own judgement about the Credibility of the Trials conducting party, be it Sports Academies or event management companies. If, for any reason, the Sports Academies or event management companies does not honour it’s commitment, Sports Fraternity will not be held responsible in any way whatsoever.
Sports Fraternity on it’s part will always do it’s due diligence before promoting Trials of any particular Sports Academy or event management companies, which can be talking on Phone, seeing their past track record, checking their reputation online, through their website etc.
Incorporated rules and policies
By using the Services, you agree to let Sports Fraternity collect and use information as detailed in our Privacy Policy. If you’re outside the Republic of India, you consent to letting Sports Fraternity transfer, store, and process your information (including your personal information and content) in and out of India.
By using Sports Fraternity, you agree to follow these Rules and Policies. If you don’t, we may remove your profile, or suspend your account.
Limitation of Liability :
Sports Fraternity won’t be liable to you for any damages that arise from your using the Services. This includes if the Services are hacked or unavailable and any other damages (indirect, incidental, consequential, special or exemplary). And it includes all kinds of legal claims, such as breach of contract, breach of warranty, any wrongful act or any other loss.
Disclaimer of warranty :
Sports Fraternity provides the Services to you as is. You use them at your own risk and discretion. That means they don’t come with any warranty.
None express, none implied :
No implied warranty of merchantability, fitness for a particular purpose, availability, security, title or non-infringement. If Sports Fraternity doesn’t exercise a particular right under these Terms, that doesn’t waive it.
Severability :
If any provision of these terms is found invalid by a court of competent jurisdiction, you agree that the court should try to give effect to the parties’ intentions as reflected in the provision and that other provisions of the Terms will remain in full effect.
Choice of law and jurisdiction :
These Terms are governed by Indian Laws, without reference to its conflict of laws provisions. You agree that any suit arising from the Services must take place in a court located in Delhi.
Entire agreement :
These Terms (including any document incorporated by reference into them) are the whole agreement between Sports Fraternity and you concerning the Services.
Fees :
If and when Sports Fraternity launches Premium features, the Fees for the same may be one time or recurring payments. The terms may be monthly, quarterly or annual, as described in the course of the transaction. Your access (to paid services) will begin only after payment of fees.
Payment :
Sports Fraternity accepts payment via the current payment method indicated at time of purchase, which may include mobile wallets, and any other form of payment that we make available to you from time to time. You agree to abide by any relevant Terms of Service or other legal agreement whether with Sports Fraternity or any other third party, that governs your use of a given payment processing method. Prices for Premium Features may change at any time, without any notice.
If you purchase any automatically renewing subscriptions, you agree that Sports Fraternity will charge the payment method on file on the first day of each billing period for the relevant subscription, and if the payment method on file becomes invalid due to an expired credit card or other similar reason and we are unable to charge you on the next billing period, Sports Fraternity reserves the right to immediately revoke your access to the Premium Features you have ordered until you payment for the same is received.
Taxes
If Sports Fraternity is required to collect or pay any taxes in connection with your purchase of Paid Services, such taxes will be charged to you at the time of each purchase transaction or other appropriate time as applicable. Additionally, if required by law, you are responsible for reporting and paying certain taxes in connection with your purchase and use of Paid Services. Such taxes may include GST, duties, customs fees, or other taxes (other than income tax), along with any related penalties or interest, as applicable to your purchase or country of purchase.
Cancellations and Refunds
Cancellation & Refunds for ground booking :
Sports Fraternity charges 10% of the ground booking amount as a commitment fee. Once a ground is booked by any member after payment of the commitment fee, the member may cancel the Ground booking before 48 hours from the scheduled Match start time & full refund of the commitment fee, after deduction of 2% processing fee, will be made to the member. If the ground is cancelled after 48 hours , no refunds will be issued.
Communications
By using Sports Fraternity Mobile App & Website, you agree to receiving communications from us including marketing communications such as newsletters about Sports Fraternity features and content, special offers, promotional announcements, and customer surveys, to your registered mobile number, e-mail, push notifications or by other methods.
